On January 19, 2023, there was a Special City Council Meeting with two closed session items. Sure, they were technically identical in name and description, with the only difference being CS1 vs. CS2 but one of them appeared to be about councilmember Karen Macedonio. The item was about potential litigation.

At the beginning of the meeting, you will hear a comment by councilmember Macedonio and a public comment by Shawn. Here is the discussion from the special meeting.

When the meeting was over, it raised a concern as to why there was no public discussion or input first. It’s also concerning as to the basis for this when it was addressed previously in August of 2021, and everyone was aware of it and the discussion. It’s furthermore concerning as to how fast this happened just after the whole issue with the selection of the mayor pro tempore that took place on January 10, 2023, 9 days prior. Why the issue in 2022 vs 2020 with the mayor pro tempore selection and was it due to the rush to pursue a quo warranto against councilmember Macedonio next in an effort to see if she can be removed from office? Does this concern anyone else? What do you think?

Keep in mind that the East Kern Health Care District doesn’t have an issue with this, in fact the EKHCD has a resolution on it, resolution 21-09-01 since 2021 regarding “incompatible offices”. After this meeting in August 2021, it's also important to acknowledge that it appears from documentation that both the attorney for the EKHCD and the attorney for the city at the time discussed this back then, and concluded they were not incompatible offices. So how in 2022 is it an issue specifically with the newly elected councilmembers, mayor, and newer city attorney since then?

The same day the email was sent to the city council, January 21, 2023, a petition was created asking the attorney general to deny the request of a quo warranto by the city against councilmember Karen Macedonio. Here is the petition.

Next, on March 7, 2023, another email was sent to the city council regarding the whole quo warranto issue and their recent appointment. Here is the email below that was sent to all the councilmembers and mayor.

Since the email above was sent, and the news article was published, it raised additional concerns due to councilmember Macedonio being pursued for a quo warranto regarding holding two offices, that some feel may be incompatible, and wondering if the same would apply to the person recently appointed. Here is a Facebook post created April 8, 2023, stating these concerns and questions.

This above concern was also raised at a city council meeting, with the answer yet to be determined (TBD).
